From The Borden Pedigree-Ancestry of Richard Borden, an early settler of Portsmouth, Rhode Island by Thomas Allen Glenn Edmund Borden is not mentioned in his father's will of 11 February, 1531 (Arch. Cant., Vol. XIX, Sec. 10). In early English wills the eldest son is seldom named because as heir, under the common law of England, he inherited by primogeniture, land not being generally devisable by testament until the Statute 32, Hen. VIII, and 34-35 of same, when two-thirds of the land in chivalry and all socage land became devisable. Notwithstanding the above statute, many wills for a long time after failed to notice the heir. In Kent, however, almost all of the land was, and is, held by the custom of Gavelkind and, in 1439, there were less than forty tenants in the entire county who held by Knight's service (Consuetudines Kanciae, Sandys, page 248). Gavelkind lands have always been alienable in perpetuity and devisable by will, whether inherited or acquired by purchase (Consuetudines Kanciae, Sandys,page 286). When a man died intestate seized of Gavelkind lands, the same were equally divided amongst his heirs, his widow's right of dower (one-half of the land) being respected. But while the Kentishman could devise his lands from time out of mind, yet, in many instances, the name of one, and often several children, not necessarily but usually the eldest, are omitted. The reason for this is apparent. In no county in England were the ancient Saxon customs regarding marriage so carefully observed as in Kent. Marriage here was not entered into in a hap-hazard manner. The groom was compelled to show that he could support a wife comfortably, and a carefully worded contract was executed, wherein the prospective bride was secured from future distress. Under the custom of Gavelkind the eldest son was no richer than his brothers; for this reason it was customary for the father to convey to his sons, in fee simple, upon contract of marriage, certain tenements, farms and fields, which they agreed to be content with as their portion of their father's estate, and thus provided for they are not afterwards mentioned. The same applies to daughters. For an example of this see will of John Borden, of Hedcorn, 1469, wherein he fails to mention his son Roger Borden, who is named in his mother's will, his son John, and daughters. See also will of William Borden, of Hedcorn, 1557, wherein he neglects to name his daughter Agnes Borden, and perhaps others, all of whom had, doubtless, been provided for by settling upon them certain Gavelkind land. In the absence of mention in his father's will my authority for the definite statement that Edmund Borden was the son of William Borden (died 1531) is that parts of certain lands and tenements in Hedcorn which before William Borden and his ancestors had been seized of, passed by the custom of Gavelkind to the heirs of the said Edmund Borden. In other words, the descendants of Edmund Borden; by operation of the custom of Gaveikind, became seized during their lifetime of and in certain lands and tenements on the High street of Hedcorn and elsewhere, which had formerly been the property of William Borden (died 1531) and of his ancestors. I am not certain regarding the mother of Edmund Borden, but suggest that she was Tamasin, the second wife of William Borden, inasmuch as the name, not then common, was continued by her descendants. ABSTRACT OF WILL OF EDMUND BORDEN, OF HEDCORN. 13 April, 30 Hen. 8(1539.) I, Edmund Borden of Hedcorn in the Shire of Kent To be buried in the churchyard of Hedcorn. Mathias Button of Ipswich deeded 9 3/4 acres near Labor-in-bain Creek to "Thomas Borman of Ipswich, cooper," in exchange for Boreman's eleven acres. On 22-Mar-1650/51. John and Mary Every sold to "Thomas Boreman" of Ipswich a twent acre island in Ipswich on 7-Oct-1652. He served on the Essex petit jury on 27-Sep-1653. On 29-Mar-1664 "Thomas Boreman, having been formerly released from training, paying something yearly to the use of the company and being behind several years, upon his wife's petition, court granted one half of what was in arrears remittred, if he paid to the clerk of the company the other half. On 27-Sep-1665 "Daniel Boreman" quitclaimed to "his father Thomas Boreman" all his right and interest in Thomas's farm, in return of £225 paid in installments; this arrangement was approved by "Mr. Thomas Borman Senior with his two sons, that is Robert Kinsmand and Thomas Low," who gave bond on the agreement. In the 1666 division of Plum Island, he received a double share, as did other wealthy men whose country rate exceeded 6s. 8d. Thomas and Margaret Boreman of Ipswich sold to Thomas Perring of Ipswich a six-acre lot of marsh at Plumb Island on 9-Dec-1667. He left a will on 16-Dec-1670 at Ipswich, Essex County, Massachusetts. He wrote a codicil allowed "my wife" the right to dispose of cattle, household goods and land "as need shall require" on 3-May-1673. The Inventory of Thomas Boreman was taken totalled £533 6s 6d, of which £350 was real estate: "the dwelling house, barn and outhousing with all lands adjoining," about 42 and a half acres, £280; and "ten acres of planting land" at Button's Point, £70 on 26-May-1673. |
