Ambrose Fish married Hannah Swift, daughter of William Swift 2nd and Ruth (Unknown), circa 1674 at Sandwich, Barnstable County, Massachusetts. Att this Court, Ambrose Fish was inditied by the name of Ambrose Fish, for that hee, haueing not the feare of God before his eyes, did wickedly, and contrary to the order of nature, on the tweluth day of July last past before the date heerof, in his owne house in Sandwich, in this collonie of New Plymouth, by force carnally know and rauish Lydia Fish, the daughter of Mr Nathaniell Fish, of Sandwich aforsaid, and against her will, shee being then in the peace of God and of the Kinge.

The grand jury found billa vera. The verdict of the jury of life and death was as followeth: Namely, if one euidence with concurring cercomstances be good in law, wee find him guilty. But if one euidence, with conccurring cercomstances, be not hood in law, wee find him not quilty.

Vpon consideration of the verdict, the Court centance him, the said Ambrose Fish, to suffer corporall punishment by being publickly whipt att the post, which accordingly was inflicted, and the prisoner released. Ambrose Fish died before 11 September 1691 at Sandwich, Barnstable County, Massachusetts. The Inventory of Ambrose Fish was taken by Thomas Tupper, ? Bassett, Hannah Fish relict on 11 September 1691. His estate was settled, Hannah to receive 1/3 part of real estate, and 10£ for bringing up ye children and 1/3 personal estate & ye son a double share, rest to be equally divided among rest of children. On 21 October 1691.

     Nathaniel Fish was also known as Nathaniel Fyshe. He was also known as Nathaniel Fish. He was baptized on 20 June 1619 at East Farndon, Northhamptonshire, England. He was the son of Thomas Fish and Mary Sprigge. Nathaniel Fish immigrated in 1635 to Lynn, Essex County, Massachusetts. He resided at at Sandwich, Barnstable County, Massachusetts, in 1637; and helped to form a new colony on Cape Cod. He was between 1637 and 1640; He was among the settlers of 1637-1640, those who were long-term settlers, along with John Fish, Thomas Burgess, and Richard Bourne. 'With them [the original 10 grantees in 1637] came also a large number of persons chiefly from Lynn, Duxbury, and Plymouth, viz: Thomas Burge, Henry Ewer, John & Jonathan & Nathaniel Fish.' It would appear that Nathaniel married more than once, as the inventory of his estate, taken 14 Mar 1693/4 and entered at Plymouth Probate Court 4 Oct 1694, mentions his last wife, Lydia Fish, as sister of John Miller of Yarmouth, MA. Another record states that he married Lydia Miller, sister of John Miller, in 1643. A Lydia Miller, daughter of Rev. John and Lydia Miller, was born 2 Feb (or 12 Apr) 1640, at Rowley, MA. No record of the first wife of Nathaniel has been found in 1643. He was in 1643 at Sandwich, Barnstable County, Massachusetts; He was on the 1643 list of those in Sandwich 'age 16-60, liable to bear arms'. He married (Unknown) (Unknown) before 1645. Nathaniel Fish was in 1658 at Sandwich, Barnstable County, Massachusetts; 'In 1658, to lay out and order the true bounds of every inhabitant's lands' Nathaniel is listed as an owner to be surveyed in Sandwich. He owned one-half of a church pew at Sandwich, Barnstable County, Massachusetts, 1658. He the owner of 1/2 of a church pew at Sandwich in 1658 at Sandwich, Barnstable County, Massachusetts, 1658. He married Lydia Miller in 1664 at Sandwich, Barnstable County, Massachusetts. Nathaniel Fish was in 1690 at Sandwich, Barnstable County, Massachusetts; The town abruptly bought of Nathaniel Fish 'the home lot of upland that said Fish now dwells on' and ordered that this lot 'together with the skirt of swamp adjoining to it on the westerly side shall lie and remain to the only proper use and behoof of the Rev Mr Rowland Cotton and his heirs and assigns forever if he shall continue amongst us ... in the work of the Ministry;' Nathaniel Fish was about seventy one at this time; There is no record of the size of his house or his reaction at this taking. From the 1667 survey, we believe this location was near the meeting house and probably on or about the present Dan'l Webster Inn site. He was in 1692 at Jarves St. to Ox Pasture Neck, Sandwich, Barnstable County, Massachusetts; The location of Nathaniel Fish's house is not clearly stated, but since it was taken by the town later as a home for Reverend Roland Cotton it was near the meetinghouse. It is probably the location of Reverend Leveridge's humble house earlier. He died in 1693 at Sandwich, Barnstable County, Massachusetts; aged about 75. His estate was proved in 1694 at Barnstable County, Massachusetts; The estate of Nathaniel Fish, totaling in all about £31, illustrates the least-propertied category in this study. He had a two-room house, five acres of upland, three acres of meadow, an ox and a cow, an old sword, a few books, two skillets, hooks and an iron pot, two pans, a 'small old bed' with bedding, and his clothing. At eight acres his property was barely sufficient for life's needs. Fish's estate went in toto to his widow as it did not even meet her reserved rights of £60 as stipulated in the marriage contract. He died in 1693/94 at Sandwich, Barnstable County, Massachusetts. He died before March 1694 at Barnstable County, Massachusetts. He left a will in March 1693/94

'An Invintory of ye Estate of Nathaniel Fish of Sandwich' was taken 14 March, 1693/4, by Daniel Wing, Sr, and John Miller. The real estate was 'house five acres of upland and 3 acres of meadow' £20. 'Lydia Fish vid Relict of Nathaniel fish' made oath to the inventory, 4 October, 1694. The estate was settled by the probate court, 4 October, 1694 as follows: 'It being made appeare that ye Sd Fish before marriage to Lydia miller his last wife did oblige him Self under his hand with witness there unto: To give to her sd Lydia as much more at his death as he had with her which was about Sixty pounds and finding his Estate Left to come Exseeding Short to answer that promise and Ingagement do See Cause to Settel all that little Estate that is left on his widow Lydia Fish'. Administration was granted to 'Sd Lydia Fish vid and her Brother John miller of yarmouth.'

I, Thomas Toby of Sandwich in the County of Barnstable in New England, being aged and weak of body yet thro' the mercy & goodness of God of Disposing mind and memory and calling to mind the uncertainty of this Transitory Life, I am Desirous according to my Duty to set things in order before God shall call me hence and therefore do make this my Last Will & Testament hereby Revoking and Disannulling all former Will & Wills by Word or writing heretofore by me made; and do hereby Constitute and Declare this to be my Last Will & Testament in manner and form following viz: my Will is to Comitt my Soul to God in Jesus Christ who gave it and my Body to Decent burial when God shall pleas to call me hence and as Touching my worldly estate which God hath beyond my Deserts bestowed on me my will is to Dispose of it as Followeth.

Item. I will and bequeath unto my loving son Samuel Toby his heirs & assigns forever the stone end of my Dwelling house in which ye sd Samuel now dwelleth and the one half of my Barn now in his possession and his Improvement and the moyety or one half part of my old field so called part of which the sd Barn now standeth; and I also give and bequeath unto him the sd Samuel Toby his heirs and assigns forever my Lott of Land Lying near ye now Dwelling house of Edward Dillingham and Adjoineth to that called ye twenty acres; ad Lott being by estimation six acres be it more or less and is bound as ye fence now stands; and ye orchard and piece of upland fenced in with it and the piece of fresh meadow Adjoining to it together with my piece or parcel of meadow ground or salt marsh Lying below ye now Dwelling House of Eliakim Tupper; only Reserving to my son Garshom convenient ways to his Lands within these Lands.

Item. I will and bequeath unto my Loving son Garshom Toby the other half of my sd old field by the barn which is now in his occupation & improvement with a convenient way to it where it is now used at ye head of ye other half and also the Little pasture called the horse pasture att ye foot of ye other piece before mentioned; and also all ye Right of my Lands on ye westerly side of ye way that Leads Down to the House in which sd Samuel now dwells and the neck of Land behind and att ye Southwest end of sd Dwelling house and so extending all Round between the Mill pond and sd fresh meadow and so home to the farm of my son Jonathan Toby Togather with all my meadow and marsh Lying below the now Dwelling House of Widow Ruth Chipman between sd house and ye Town Harbour near Skaffold point so called and also ye Least piece of my meadow in ye on pasture neck so called Lying between yea meadow of Shubal Smith and Jashub wing with all my meadow & upland Lying between the fords so called having the meadow of William Bassett on the one side and ye meadow of Mr. John Smith & Stephen Skeffe Esq on ye other side Together with All my meadow and marsh Lying over ye creek on Sawpit neck side as also all my upland adjoining to that meadow excepting two acres att ye upper end; Together with the other part of my Dwelling House being the southwest end of it; and also the other half of my sd barn with free Egress and Regress To and from the same; All which sd Parcels of upland and meadow ground to be to the only proper use & behoof of him the sd Garshom Toby his heirs and assigns for ever.

And I Do also will and bequeath unto them the sd Samuel toby & Garshom Toby my sons their heirs and assigns forever my Lott of land in ye Towneck so called and my twenty acres of Land formerly Given to me by Quachatasett Indian Sachem Lying near Snake pond as also my twenty acre Lott and my forty acre lot that is yet to be Taken up and divided; as also all my Right in the Comon or undivided Land in sd Town of Sandwich all which is to be equally Divid between them; But the Condition on which I give all the sd Lands & meadows unto the sd Sam'l & Garshom is that they or their heirs exec'rs or admin'rs Do Keepe maintain yr uncle Samuel Knott During ye time of his Naturall Life both with food Drink Lodging and Apparill and to allow him a decent Buryal after his death.

Item. I do give and bequeath unto my son Jonathan Toby his heirs and assigns forever ye lands on which he now Dwells and in his possession and my biggest piece of meadow in sd ox pasture.

Item. I give and bequeath unto my grandson Thomas Toby or Yarmouth besides what I have already given him one heifer of two years old and one shilling in money.

Item. I give and bequeath unto my son Nathan Toby his heirs & assigns forever all those my Lands att & near his Dwelling house now in his possession and the two acres of Land before Reserved in Sawpit Neck.

Item. I give and bequeath unto my Grand daughter Sarah Toby the daughter of my son Ephraim Toby Deceased that Lott of Land on which her mother Hannah Toby now dwells and to her heirs and assigns forever; provided that she live to the age of one and twenty years or marry but if not then to be Equally divided amongst all my sons Then surviving.

Item. I give and bequeath unto Hannah my Loving wife all the Estate which she had when I married her and what she now hath which she gott by her own Labour or that was Given to her; and one Cow and all ye money which she shall have of mine in her hands at the Time of my Death.

Item. I give and bequeath unto each of my three daughters five shillings apiece; and what other Estate shall be left of myne when Debts Legasys & Funerall charges are paid out my will is that it be Equally Divided to and between them the sd Sam'l and Gershom Toby whom I Do ordain & constitute to be Joynt Executors of this my will. In testimony whereof I have hereunto sett my hand & seal this 29th of March 1709-10.

     Eliakim Tupper was born on 29 December 1681 at Sandwich, Barnstable County, Massachusetts. He was the son of Capt. Thomas Tupper and Martha Mayhew. Eliakim Tupper married Johannah Fish, daughter of Ambrose Fish and Hannah Swift, in March 1707 at Sandwich, Barnstable County, Massachusetts. Eliakim Tupper held the position of selectman in Sandwich, MA between 1712 and 1724. He held the position of a committe "to supply the pulpit" in 1722. On 13 April 1732 He did not agree with the doctrine preached andwas one of the contractors who built a new metting house for the opponents of the established minister.
He resided at at Lebanon, New London County, Connecticut, in 1736. He died between 1755 and 1760 at Lebanon, New London County, Connecticut.
